Buyer Obligations:
The Buyer agrees to provide a lifelong commitment to the puppy, including a comfortable environment, prompt medical attention, proper grooming, and responsible care. This includes keeping the puppy free of internal and external parasites, infection, and injury. Proper nutrition must be provided at regular intervals, and fresh, clean water must be available at all times. The Buyer promises to provide a safe environment for the puppy, never allowing it to roam freely without proper fencing or supervision. The Buyer will not leave the puppy alone for more than 8 hours at a time regularly. The Buyer agrees to keep the puppy in a clean environment, with bedding that is routinely washed or changed and free of bodily wastes. The puppy will be kept in an area with proper ventilation/air conditioning and a comfortable temperature between 65 and 80 degrees Fahrenheit. The Buyer is required to provide positive reinforcement training and routine preventative care, including annual veterinarian examinations, regular flea/tick/heartworm medication (as recommended based on geographical area and risk factors), deworming, vaccinations, and any additional medical care as needed.
Spaying/Neutering:
Applicable/Non-applicable (circle one): The Buyer agrees to spay/neuter the puppy between 12 and 24 months of age.
Stud Service:
Applicable/Non-applicable (circle one): The Buyer agrees to provide stud service(s) back to the Seller until pregnancy(s) is/are complete. One stud service is considered complete once the Bitch gives birth to at least three puppies, each living to 60 days. The Seller will pay for all expenses associated with the stud service, including transportation, collection, preservation, and shipment of semen. The Buyer agrees to maintain communication with the Seller and provide information regarding sperm count and readiness of the dog to breed.
Registration Papers:
Applicable/Non-applicable (circle one): Registration papers with Full Registration/Limited Registration will be given to the Buyer from the American Kennel Club (AKC). Limited AKC registration papers will be given to the Seller once proof of spay/neuter is presented. No guarantee is given to fertility or ability to produce offspring.
Diet:
The Buyer agrees to continue the exact diet the puppy was started on for a minimum of three months after leaving the Seller. The Buyer understands that switching the diet during the transitional period may cause significant gastrointestinal distress. Any issues with appetite, obtaining the proper food, or interest in switching the diet must be discussed with and approved by the Seller.
Health Guarantee:
The Seller guarantees this puppy/dog to be in good health. To validate this guarantee, the Buyer must have the puppy examined by a licensed veterinarian within 72 hours of receiving the puppy. The Buyer must inform the Seller of the veterinary exam results within 24 hours via email. Failure to do so will terminate this agreement. The puppy is warranted for one year against fatal and life-altering congenital diseases, including kidney, heart, pancreas, spine, and liver problems. Conditions must be of a severe, life-threatening nature.
Health Defects:
The puppy must show a defect within one year of age. The Seller must be notified of the problem within 48 hours of diagnosis. The Buyer must produce reports from two licensed veterinarians from two unassociated veterinary clinics, confirming the same diagnosis and conclusion. The Buyer must obtain all veterinary records and forward them to the Seller within 48 hours of the first diagnosis. The Buyer must return the puppy to the Seller within ten days of the first diagnosis. The affected puppy must be in good condition, other than the specified problem. The Buyer is responsible for all shipping costs, including the shipping of the affected puppy back to the Seller and the shipping costs of sending a replacement puppy if needed. No replacement will be given if the puppy is euthanized without the Seller’s permission. If the puppy dies within the one-year warranty, the Buyer must have an autopsy performed to determine the cause of death. No replacement will be given if the affected puppy dies without an autopsy or if the autopsy does not show a congenital disease. If an autopsy confirms the cause of death as congenital, the Seller will replace the puppy within one year with a puppy of equal or lesser value. The replacement puppy will be chosen by the Seller. No monetary refunds will be given. The Seller is not responsible for veterinary costs and will not pay any medical bills. Once the puppy is paid for and living with the Buyer, the Buyer is fully responsible for all veterinary bills.
Vaccinations:
The puppy has received vaccinations for parvovirus and distemper and is warranted against these viruses for 48 hours upon receiving the puppy. The Buyer must have an ELISA test performed within 48 hours to claim either of these viruses. This test can be requested at the puppy’s first veterinary appointment.
Exclusions from Health Guarantee:
This contract does not cover common health conditions specific to the French Bulldog breed, including ear infections, eye infections, skin infections, cherry eye, entropion or ectropion eyelids, loose hips, loose knees, elongated soft palate, hypoplastic trachea, stenotic nares, inverted tails and corkscrew tails, allergies, fertility issues, parasitic infections, fungal infections, bacterial infections, respiratory infections, undescended testicles, uneven bites, localized demodex, coccidiosis, kennel cough, giardia, and diarrhea. Many of these conditions can be potentiated by the stress of separation and change in environment. The Seller will disclose any health conditions found during the puppy’s well check before coming home. Conditions not found during the exam cannot be disclosed as the Seller has no knowledge of their existence at that time. The Seller will make every effort to be transparent regarding health before the puppy comes home with the Buyer.
Exclusions from Coverage:
A puppy that has died from anesthesia due to surgery, sudden death from choking on an object, falling, being run over by a vehicle, or any other trauma is not covered by this contract. It is the Buyer’s obligation to watch the puppy at all times. Any physical problem caused by accident, injury, neglect, or poor diet is not covered by this contract. Mental health issues, aggressive or unfavorable behavior, which can be prevented with obedience training and proper socialization, are not covered by this contract.
Neglect or Rehoming:
If at any time it comes to the Seller’s attention that the puppy was neglected, the Buyer agrees to forfeit ownership and promptly return the puppy to the Seller at the Buyer’s expense. If the Buyer is no longer able to provide a comfortable and safe home environment for the puppy, the Buyer must return the puppy to the Seller without compensation. The Buyer cannot re-sell, re-home, or give the puppy up to a shelter for any reason. The Seller has the sole right to assume responsibility for the puppy if the Buyer is no longer able or willing to be responsible for the puppy.
Contract Execution and Termination:
The Buyer must sign this contract when the non-refundable deposit is placed. Failure to return a signed contract to the Seller before the puppy is released will result in the cancellation of this contract, forfeiting any right to compensation from the Seller. The Seller has the right to terminate this contract at any time for any reason between the period the deposit is placed and before the puppy is received. If the Seller decides the Buyer is no longer a good fit for the puppy, the Seller will return the deposit. However, if the Buyer decides they no longer want the puppy after placing a deposit but before picking up the puppy, the Buyer forfeits their deposit.
Veterinary Care:
Prior to leaving, the puppy will have received a veterinary examination, at least one set of age-appropriate vaccinations, and deworming multiple times. The Seller will provide a hard copy record of the vaccinations and deworming given to the puppy.
Non-Refundable Deposit:
The Buyer understands that the deposit placed to hold the puppy is non-refundable and cannot be switched to another puppy unless agreed upon with the Seller. This contract applies only to the original Buyer and is non-transferable. There are no warranties, either expressed or implied, except as set forth in this agreement. By signing this contract, the Buyer agrees and accepts all terms and conditions.
Pick-Up and Transportation:
The puppy must be picked up or transported to the Buyer, at the Buyer’s expense, at eight weeks of age. The Seller will help with travel arrangements but is not responsible or liable for the puppy once it leaves the Seller. If the Buyer cannot pick up the puppy at eight weeks old, a late fee of $35 per day or $250 per week will apply for up to a maximum of four weeks. After four weeks, the Buyer forfeits their deposit, any right to the puppy, and any right to compensation from the Seller.
In Case of Inactivity:
If the Seller is unable to reach the Buyer for more than two weeks, the Buyer forfeits their deposit, any right to the puppy, and any compensation from the Seller.
Contract Acknowledgement:
The preceding paragraphs contain conditions established to ensure the well-being of your new family member. Both parties have read and fully understand and agree to all terms and conditions of this contract. By signing, the Buyer acknowledges receipt of a copy of this contract. This puppy sales contract and health guarantee is governed by the laws of Florida.
